Where these terms and conditions use terms such as "we", "us" and "our" they refer to Blue Island Home Ltd.

We offer this website, including all the information, tools and services available on it, on the condition that you accept these terms and conditions and the associated privacy policy available on our website.

By visiting our website and/or purchasing something from us, you are deemed to have accepted these terms and conditions.

We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions and ensure you understand them before making a purchase.

2. GENERAL CONDITIONS

2.1. We reserve the right to refuse service to anyone, for any reason, at any time.

2.2. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices.

2.3. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website.

2.4. Headings and titles used on this website are done so for convenience only. They do not constitute any part of the terms and conditions and will not limit or otherwise affect the terms herein.

3. ONLINE STORE TERMS

3.1. Our website offers a range of products for sale. Where we refer to an 'item' we are referring to a single product available for purchase on this website.

3.2 We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.

3.3. Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing. Your goods will not include any of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown assembled they may require assembly by you. From time to time to time we update our designs or make improvements to fixtures and fittings etc. These changes may not be reflected in photography and drawings on the site.

3.4. Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.


3.5. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

       i) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

       ii) There has been a pricing or product description error

       iii) There is a system or procurement failure

       iv) You have failed our customer validation checks

3.6. When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

3.7. Your order will only be accepted by us once your goods have been dispatched.

4. MODIFICATIONS TO OUR SERVICE AND PRICING

4.1. Prices for items are subject to change without notice.

4.2. We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.

4.3. We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.

5. HOW TO PLACE ORDER


5.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.


5.2 Delivery is free to most UK mainland addresses. Please see our list of surcharge areas in our “Delivery” section.  If you live in a surcharge area and place your order on the website, we will contact you to collect the additional delivery costs.


5.3 You will be required to pay for the goods in full at the time of ordering.


5.4 We use secure payment facilities for online purchases. You can pay for your order by American Express, Visa, Mastercard, Delta/Connect, Klarna or PayPal via our PayPal payment portal.


5.5 Promotional prices only apply during the period stated.


5.6 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.


5.7 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.


5.8 Once your order is complete, we will notify you of the dispatch date.


6. DELIVERY & CARRIAGE CHARGES

6.1 Goods will normally be dispatched within 5-10 working days for Pine products and 10-15 working days for oak products. Any estimated dispatch date is an estimate, which can change without notice.


6.2 We will normally deliver goods within 3-5 working days of dispatch.


6.3 Your order may arrive in more than one delivery.


6.4 We can deliver our products anywhere in the UK.


6.5 We will deliver the goods to the premises you specify on your order. You must be at home to accept delivery of your order, which is normally between 9:00am and 6:00pm Monday-Friday. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended. If you would like to specify a delivery date, please contact us on the email address above.


6.6 Most of our products are relatively heavy items and you may be required to assist the driver in offloading your order. Our standard delivery service is to deliver items to your front door or to the communal entrance of your address on the ground floor. Any additional help provided by our drivers is at their own discretion.


6.7 Disposal of packing materials is your responsibility.


6.8 After a failed delivery attempt (or if you are not at home for an agreed delivery) the goods may be returned to us and we reserve the right to charge you an additional re-delivery charge.


6.9 If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery.


6.10 Please check the goods on delivery – any goods found to be missing or damaged should be notified to the delivery driver at the time of delivery. We recommend signing any receipt of goods documentation with “Unchecked” if you do not check the delivery before signing receipts.


6.11 If the goods are lost or damaged in transit, please let us know promptly.


6.12 Deliveries are made to a ground floor entrance only and on the condition that there is reasonable access for the safe and prompt delivery of the goods. You should tell us about any special delivery requirements or conditions when you place your order.


6.13 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We will try to put things right as soon as possible however we can’t be responsible where this causes a delay or failure in delivering your goods.


6.14 Time is not the essence of the contract unless expressly stated otherwise in writing by a Director of the Company.


7. FAULTY GOODS / GUARANTEE


7.1 If there is a problem with the goods, please notify us by email providing details of the problem. It is helpful if you can provide us with a digital photograph/video of the problem as this normally saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.


7.2 All goods are guaranteed for 12 months from the date of delivery. Within this time scale we will replace defective goods (not due to wear and tear, misuse or natural movement and ageing of wood) free of charge. 


7.3 Our warranty is provided in addition to the rights that the law says you have as a consumer and accordingly, your statutory rights are not affected.


7.4 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received at our warehouse and checked. The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.


7.5 All products should be cleaned in accordance with our care and maintenance instructions where applicable.


7.6 It is your responsibility to ensure the environment that you wish to place the items is suitable for such products. Note that the surrounding air temperature plays an important role in relative air humidity. Changes in the temperature can cause the wood to quickly react by expanding/contracting. This movement can cause the wood to move (warp/cup) and new shakes (cracks) to open. This could result in openings at the joints.  As a result, furniture should not be placed near strong heat sources such as radiators and wood burners, etc. Likewise, furniture should not be stored in places where the temperature can suddenly change such as outdoors, conservatories, or outhouses etc. We cannot be held responsible for changes in the wood due to environmental factors once the delivery has been received. Such changes are not considered manufacturing faults under the terms of the item's warranty.


7.7 If an item is no longer available we will offer an alternative. However our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance you will have the option of a refund.


7.8 We are unable to guarantee an exact colour match due to the nature of the product.


8. LIABILITY AND INDEMNITY

8.1 The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.

8.2 We do not accept liability for any consequential loss of profit or indirect losses. You should therefore not book installation of the goods until you have received them and inspected them.


9. EXCLUSION OF LIABILITY

 

We take all reasonable steps to ensure that the information on this Website is correct. However, we do not guarantee the correctness or completeness of material on this Website. Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss.


10. JURISDICTION

These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

11. ENTIRE AGREEMENT

These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.

12. GENERAL

12.1 Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

12.2 Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
